Zellers v. City

Former Partners Lecia L. Chaney and Teri Danish represented the City of McAllen in this case where Plaintiffs were forty-four police officers who were suing the City for back pay for being on stand-by from the 1997 – 2001 timeframe. Plaintiffs filed the claim as a breach of an express or, in the alternative, an implied contract and asked for in excess of $2,000,000 in back pay and attorneys’ fees. Trial began on October 20, 2009 and concluded after approximately 10 days of testimony on November 3, 2009. Forty-eight witnesses testified. The jury returned a complete defense verdict finding that there was no contract, express or implied. Plaintiff is expected to appeal the jury’s finding.
