Partners Jaime A. Saenz and Alison D. Kennamer of the firm represented Ford Motor Company on this trial of Ford’s defenses to breach of contract claims that arose when Ford refused to fund a settlement reach during the first trial, into which it entered after receiving a jury note asking “What is the maximum amount that can be awarded?” After learning that the presiding juror sent the note without the agreement of other jurors, Ford asserted defenses to the settlement agreement of mutual mistake, unilateral mistake, fraudulent inducement by the presiding juror, and fraudulent inducement by or at the direction of Plaintiffs or their agents or representatives. Trial began on October 5, 2009, with jury selection, and continued through October 9, 2009. On October 12, 2009, the jury returned a verdict finding that the affirmative defenses of mutual mistake, fraudulent inducement by the presiding juror, and fraudulent inducement by or at the direction of Plaintiffs or their agents or representatives all applied. Plaintiffs’ counsel has filed an appeal of this verdict.
