Dora Ayala vs. Adrian Garcia

Partners Carla Martinez Saenz and Alison W. Colvin defended Adrian Garza in a personal injury lawsuit filed on behalf of Dora Ayala in the County Court of Law Number 4 in Cameron County, Texas. The lawsuit arose from a two-vehicle car accident on May 16, 2015 in Harlingen, Texas.

Plaintiff sued Adrian Garcia for Garcia’s negligent operation of the vehicle, including failing to keep a proper lookout, failing to yield to the right of way, failing to timely apply brakes, failing to maintain control and changing lanes when unsafe, among other contentions.

The Plaintiff claimed soft tissue neck and back injuries. The paid past medical expenses was approximately $10,000.00. The defense of the case focused on the contributory negligence of the Plaintiff in causing the car accident, the fact that the accident was a minor impact and the unnecessary care provided to Plaintiff. Both parties retained damages experts. The case was tried for one week beginning on October 29, 2018. Plaintiff asked the jury for $43,000.00 in closing statements including past medical expenses and past and future pain and suffering and impairment. The jury returned a verdict in favor of the Plaintiff for $20,237.00 and assigned 15% comparative fault on Plaintiff. The jury awarded no damages for future pain and suffering or impairment. The reduction resulted in a total award of $17,301.45.
