Daniel Davis, et al. v. Union Pacific Railroad Company

Partners Norton Colvin, Mitchell Chaney and Tony Rodriguez defended Union Pacific Railroad Company in a property damage/loss of business lawsuit filed on behalf of Daniel Davis and Davis Heavy Haul Transport, Inc.(DDHT). The lawsuit arose from damages sustained by Mr. Davis and DDHT when the over-width, over-weight tractor trailer owned by DDHT became incapacitated while stopped on a Union Pacific Railroad highway crossing. The trailer and its cargo were declared a total loss. In addition to property damages for the tractor, trailer and cargo, Mr. Davis and DDHT also claimed loss of business/loss of profits of over a million dollars during the time that the tractor involved in the incident was being repaired. Trial began with jury selection on October 13, 2015 and ended with a defense verdict on October 19, 2015.
