Andrea Amaro and Martin Amaro v. National Lloyds Insurance Company, et al.,

Attorney Victor Rodriguez served as co-counsel to Scot Doyen of Doyen Sebesta, LLP in the defense of National Lloyds Insurance Company in a first-party insurance lawsuit filed by Martin and Andrea Amaro. The Amaros submitted a claim on their homeowner’s insurance policy related to two catastrophic hail storms that occurred within weeks of each other in the spring of 2012 in Hidalgo County. National Lloyds subsequently paid the claim, but the Amaros were not satisfied with the claim settlement. The Amaros asserted claims for breach of contract, insurance code violations, and fraud. The Amaros’ chief complaint was that National Lloyds applied excessive depreciation to their roof. The Amaros also alleged that National Lloyds improperly denied claims for damage to the interior of their home and to the home’s air conditioner system, and that National Lloyds acted in bad faith by failing to assign a Spanish-speaking adjuster to investigate their claim. The Amaros asked for approximately $14,000.00 in actual damages and $200,000.00 in attorney’s fees. After a six day trial, a jury returned a complete defense verdict on March 2, 2015. The Amaro’s lawsuit was the first of over 10,000 cases filed in Hidalgo County stemming from the 2012 hailstorms to go proceed to trial.
