Partner Jaime A. Saenz and Norton A. “Trey” Colvin III of the firm defended Ford Motor Company in this marketing defect wrongful death action. This jury trial began on September 19, 2011 in Alice, Texas. Plaintiffs alleged that Ford should have warned purchasers of a 1999 Ford Escort to only use the tire jack originally provided with the vehicle. Decedent Luis Aguilar was using an alternate jack and working underneath the vehicle when it rolled backward, resulting in his death. The jury returned a defense verdict on September 23, 2011, shortly after the close of evidence, finding no marketing defect and that Plaintiffs’ decedent was negligent.
