Texas Deceptive Trade Practices Act
In general, the Texas Deceptive Trade Practices Act was designed to protect consumers from fraud. Enacted in 1973, the DTPA is set out in the Texas Business and Commerce Code Section 17.41, et seq., and prohibits false, misleading or deceptive conduct in trade or commerce. The act also allows plaintiffs to seek both attorney's fees and treble damages.
Within the DTPA there is a "laundry list of violations" that an individual, business or corporation can be accused of and includes:
- Passing off goods or services of another as one's own
- Representing goods as new or original if they are in fact deteriorated or secondhand
- False or misleading advertising
- Misleading statements of fact regarding price
- Misrepresentations of authority
- False warranties
- Price gouging or improper claims handling following a disaster
