Trial Activity

Zellers v. City of McAllen, Cause No. C-902-01-F in the 332nd Judicial District Court of Hidalgo County, Texas Judge Mario Ramirez presiding. Lecia L. Chaney and Teri Danish of the firm represented the City of McAllen in this case where Plaintiffs were forty-four police officers who were suing the City for back pay for being on stand-by from the 1997 - 2001 timeframe. Plaintiffs filed the claim as a breach of an express or, in the alternative, an implied contract and asked for in excess of $2,000,000 in back pay and attorneys' fees. Trial began on October 20, 2009 and concluded after approximately 10 days of testimony on November 3, 2009. Forty-eight witnesses testified. The jury returned a complete defense verdict finding that there was no contract, express or implied. Plaintiff is expected to appeal the jury's finding.
