Yolanda Gonzalez-Alaniz v. J.C. Penney Corporation, Inc. d/b/a J.C. Kennamer of the firm represented Defendant J.C. Penney Corporation, Inc. Plaintiff alleged that J.C. Penney negligently hired and failed to train its stylists and that it was liable under a respondeat superior theory for the actions of a hair stylist who Plaintiff claimed failed to use the appropriate hair coloring solution for sensitive scalps during a May 6, 2005 hair appointment. Plaintiff alleged she experienced an allergic reaction including blisters, migraine headaches and other neurological symptoms. Trial began February 9, 2009 and concluded with closing arguments on February 13 2009. The jury answered the negligence question in the affirmative and awarded $20,362.36 in past medicals and $20,000.00 in past pain and suffering/mental anguish but $0.00 in future medical expenses and/or pain and suffering/mental anguish.
