Kendra Dale v. J. C. Penn[e]y, Inc. Cause No. 2005-11-5544-G, in the 404th Judicial District Court of Cameron County, Texas, Judge Elia Cornejo-Lopez presiding. Partner Alison D. Kennamer and associate Justin S. Dinsdale defended J.C. Penney, Inc. in connection with a negligence claim filed by Plaintiff alleging misidentification of a shoplifting detainee. The shoplifting detainee was issued a citation by the Harlingen Police Department rather than being taken to jail. Plaintiff alleged damages as a result of her arrest after the detainee failed to appear in response to the citation. J.C. Penney denied that it was negligent in connection with the detention and denied that its action were the proximate cause of Plaintiff's claimed injuries and damages. The case was tried to a jury beginning October 26, 2009. On October 30, 2009, the jury found no negligence on J.C. Penney was a proximate cause of the occurrence in question.
