Melissa Canales, Individually and as Representative of the Estate of Misael Canales and as Next Friend of Yasmine Canales, minor, and Arnuldo Canales and Elvira Canales vs. Ford Motor Corporation [sic] and Hector Javier Garza d/b/a Zarate's Auto Sales, Cause No. 2932-04-H, in the 389th Judicial District Court of Hidalgo County, Texas, Judge Leticia Lopez presiding. Jaime A. Saenz of the firm represented Ford along with two additional counsel in this wrongful death lawsuit alleging that the decedent's 2002 Ford Escape's powertrain control module was calibrated incorrectly and caused a stall, leading to the accident at issue. The vehicle was within a recall population for such a condition, and Plaintiff's recall notices had been returned as undeliverable, but Ford contended that this vehicle did not experience the recall condition and could not experience it at the 65 m.p.h. range in which Plaintiff was traveling at the time of the accident. Trial began on August 6, 2007, and concluded on August 15, 2007, with a complete defense verdict.
