Jaime A Saenz and Norton A. "Trey" Colvin, III defended Rio Grande Steel, Ltd., a non-subscriber to worker’s compensation, in this suit arising out of an alleged injury to an employee. Armando Garcia, a driver for Rio Grande Steel, alleged that he incurred an injury falling off of a Rio Grande Steel delivery truck due to the alleged negligent failure to provide the elements of a safe workplace, including additional personnel, a forklift and/or other safety equipment. Garcia suffered an alleged fractured ankle and other alleged injuries. Trial to a jury began on October 30, 2006, and after five days, on November 7, 2006, the jury rendered a verdict that found Rio Grande Steel liable. Plaintiffs had requested over $1 million in damages; Rio Grande Steel had argued for findings between $150,000.00 - $200,000.00. The jury made findings totaling $189,751.88.
