Francisco Jaramillo v. Alejandro J. Muniz and La Plaza Adult Day Care Center, Cause No. 2004-CCL-671-B in the County Court at Law No. 1, Cameron County, Texas Lecia L. Chaney represented Francisco Jaramillo in this lawsuit, arising out of a July, 2002 auto accident in which Mr. Jaramillo was rear-ended by a van owned by La Plaza Adult Day Care Center and driven by Alejandro Muniz. The 45- year old sustained injuries to his neck and low back; Plaintiff’s treating physician testified that he was a candidate for an inter-body spinal fusion with a 40% chance that a second surgery would be needed. While both parties agreed Plaintiff had a pre-existing spondylolysthesis, they disagreed as to whether it was aggravated by the accident. Trial began on or about May 15, 2006, and after a two-day break, concluded on May 22, 2006. During the trial, Defendants did not contest liability but claimed that Plaintiff’s condition was not aggravated by this accident but instead by his work as a landscaper. The jury rendered a verdict in favor of Plaintiff in an amount of $155,000.00. The damages were broke down as follows: $100,000.00 for future medical expenses, $5,000.00 for past medical expenses and the remaining $50,000.00 dedicated to past and future pain and suffering as well as past and future physical impairment.
