Mario A. Galvan Castro v. Ford Motor Company, Middlekauff Ford I., L.P. d/b/a Middlekauff Ford and Cardenas Motors, Inc., Cause No. 2002-04-001555-C in the 197th Judicial District Court of Cameron County, Texas Senior Partner Eduardo Roberto Rodriguez and Partner Jaime A. Saenz assisted in the defense of Ford Motor Company beginning on March 24, 2003. In this case, Plaintiff was driving his 1997 Ford F-150 Supercab pickup while driving down a Missouri hillside at approximately 2:30 a.m. after drinking a number of beers, when he went off road, lost control and rolled, landing on the vehicle's roof. Plaintiff received a paralyzing neck injury in the accident and sued claiming a defective roof structure. After a more than two week trial, the jury found that Ford was 70% responsible and Mr. Galvan Castro 30% responsible, with damages of approximately $13 million in actual damages and $5 million in punitive damages. With pre-judgment interest, the judgment in favor of Plaintiff and against Ford was $15,042,414.20. Post-trial motions by Ford are pending.
