Brenda Pena, Individually and as Representative of the Estate of Jose Humberto Hernandez, and on behalf of Jose Humberto Hernandez, Jr., Minor and Sherlyn Hernandez, Minor, Sergio Hernandez and Elizabeth Gloria Segovia v. Valbar, Inc., Cause No. C-2412-07-E in the 275th Judicial District Court of Hidalgo County, Texas; Judge Juan Partida presiding. Partner Norton A. Colvin, Jr. and associate, Alison W. Colvin acted as counsel on behalf of Defendant Valbar, Inc. in this non jury trial based on the alleged wrongful death of Jose Humberto Hernandez, a worker at the Santa Rosa Sugar Mill. Plaintiffs claimed that Valbar was negligent in failing to train and supervise its employee and by failing to conduct an engineering survey and demolition plan for the project. Trial began on August 10, 2009 and concluded on August 12, 2009 with closing arguments to the bench on August 17, 2009. On September 15, 2009, the Court issued a judgment against Valbar, Inc.
